Hello! I just needed some advice about my job! ^_^

I have been trying to quit for some time now, mainly because they hired me as a full time employee and, after having to cut people's hours MAJORLY because they over-hired, had to cut the full time people down to part time hours, and the part time down to like 8-16 hrs a week. They moved me and another girl to 8-16 hours despite being hired full time. NOW they're calling me and this other girl a liar (the exact word we heard them use) because we "claim" to have been full time. The other girl quit, I'm not sure how she did it, I didn't talk to her much other than ranting about how they were being terrible to us.

The employees there give me dirty looks and prank call me, and basically want NOTHING to do with me because I'm not like them (drunks who care nothing about anyone else). One of the assistant managers always calls me a geek, says I have no life, and the other day when I basically had to lean on a nice old lady that works there to keep me from passing out (I was REALLY sick that day, I have blood sugar problems), they lied to the lady that they would let me go home soon (because she yelled at them and was outraged...she wanted me at a doctor). The second she left and I asked, they said no, I needed to stay for the next 5.5 hrs like I was scheduled. I wouldn't have had too much of a problem with them needing me to stay that much, however the part that makes me mad is that they lied AGAIN to the poor old lady.

I have been trying to quit. A week ago, I attempted to put in my weeks notice (because that's all they really can do, they want to get rid of people asap when they quit because of the over-hiring). It didn't work because the main manager needed to be told, and the managers that were there couldn't do anything about it. I was going to quit yesterday, but again, no main manager. I told the Asst. manager again but he basically stared into space and ignored me the three times I brought it up. When I call, they're going to give me a very hard time and call me a liar again because theres no proof I tried to quit a week ago, and I'm not very good at these things to begin with ^^
Plus they have a history of basically saying "No, you can't quit" and basically making the employee feel like garbage until they agree to work more. And I just can't stand up to that...

So...I'm just basically stuck. lol Any suggestions? I know this is a strange situation, but any help is appreciated ^_^ I'm ready to try almost anything to get rid of these horrible people lol

Oooh thanks! That's a GREAT idea! That'll show them. When my mother found out that they called asking obscene questions and saying dirty things on voicemail...and especially the manager thing...she wanted my phone to call the people back and yell lol She was MAD lol

yeah, a lot of peole I've been talking to say, "They're not worth it, don't go back!" I was just afraid they would fire me if I stopped showing up...but they kinda can't fire me if I'm never coming back anyway lol

Just collect your last pay check, cash it at their bank that day, so they can't stop payment, and write them a letter telling them you quit effective immediately. Leave your keys and anything else that belongs to them when you leave.

Or don't show up, get fired and collect unemployment insurance.

Last time I checked, this is a free country, and you can work where ever you like!

You don't need proof that you've tried to quit.

Depending on your circumstances, if you were full time and were cut back to parttime you can collect unemployment.

You cannot collect unemployment if you are fired for cause (doing something wrong, not showing up, etc.) and so if you are going to quit I would recommend doing so in writing, listing the reasons why your work environment is hostile.

Then leave. There have to be far better places than that.

Good luck.

Thank you all so much, you've really helped Smile I think the writing is the best thing because it eliminates me having to talk to the manager face to face (because he makes me nervous and he will pretty much say no we need you, you can't quit...even though I technically can, I have a problem with saying no to people lol). Plus, I was always able to express myself better on paper than verbally.

In the US, you have the right to quit your job anytime you want. It is however good practice to:

1) Put is in writing. If none of the managers will accept the letter, then send the letter to the place of business (to the attention of the main manager) by certified, signed return receipt mail. That way, they cannot say that they never saw the letter.

2) It is custom in the US to give 2 weeks notice to quit. You can negotiate that with the company however once you have given them 2 week notice.

Also, in the US, if they try to stop payment on a payroll check, you have the right to complain to your state labor department and force the company to pay you all wages due. This can include interest and penalties. Most companies unless they are not legit will stop payment on a payroll check. In fact, in bankruptcy proceedings, persons owed back wages are usually at the front of the line to collect what is due them.

I hope this helps

yes,

write a letter to the head of HR (or equivalent), each manager up the chain, the CEO/pres if you can stating you are invoking the two-week clause (or whatever) and state previous attempts to do so with managers x, y, and z were ignored.

that will get a) get their attention and it will most likely not be ignored and b) you will get hell from those managers so don't expect any kind words if you list the company on your resume

I think you meant to say "will NOT stop payment on a payroll check".

We have the same rules here in Canada - an employer must give notice or pay in lieu of notice unless firing "for cause" (ie: theft), but an employee can quit at any time without cause or notice. In cases where the employer isn't a complete a**hole the employee is expected to give notice as well, if only so that they will get a decent reference for the next job. Most employees also realize that while the boss may be a complete idiot their coworkers are usually not at fault, so giving notice to quit prevents the other unfortunate victims from having to cover you on short notice.

Even if the company is not quite legit, it's still in their best interests to treat you right. I got fired by a guy who was "cooking the books". When he didn't give me my severance within 14 days as required by law, I went to the government and reported both the fact that I wasn't paid *and* the fact that he was falsifying his tax information. Revenge *is* a dish best served cold.
