I take the view that no public official can deny a service to a person where that person is entitled to that service.
"I refuse to issue a driver's license to you because you have red hair"
"I refuse to marry you, because you are of different races."
"I refuse to marry you because you are both of the same sex." (in jurisdictions where same-sex marriage is legal)
"I refuse to issue you an immigrant visa because you are a Bhuddist"
All of these refusals follow the same logic. If you cannot, in good conscience, perform the public office to which you have been appointed, it is your ethical responsibility to resign your office, rather than to deny services to people who the Government has said are entitled to it. The public official is not a law unto himself or herself.
This does not, however, extend to non-government officials who are delegated that authority. A Roman Catholic priest is perfectly free to refuse to marry a person who is previously divorced with a living former spouse, because such a marriage is not canonically acceptable within his Church. _________________ --James

I just watched a T.V. interview of this Justice of the Peace. He says he has no legal power to grant marriage licenses, so he has no power to deny such licenses. He said he recused himself from performing the requested marriage ceremony which he has the legal right to do. Hence he is off the hook legally. Politically, he caused a stink, which may cost him his job as J.P

Jindal may be running for something, but Justice of the Peace is the smallest and most local of law, elected by a small area. The People.
He has the right to recluse himself, and the subject is well known in Hammond, he does not perform mixed marriages, because the same people who got Jindal elected, the Klan, might well kill him.
Maybe not as much as in days past, the last black lynched for dating a white girl was five years ago. That we know of.
Terrorists are part of our reality.
Any Judge may marry people, but only if they want to. The same goes for Ministers.
Jindal is Governer, he has nothing to do with the Court System, seperation of powers.
It is not within his power to fire any Judge. That is the job of the Courts, who hold the same rights as the Justice of the Peace, he can be removed only for bad behavior, not for Reclusing himself, and telling the plain truth.
Another version of what he said would be, around here you can get killed for that. I do not want your blood on my hands. Also, the child of a mixed couple would be in danger, if he dated a white girl.
He is right, mixed marriages do not last, when one or both get killed.
Since it did make national news, it has been discussed at the Duke National White People's Party meetings, the Klan meetings, which have the same Christian Identity Movement views, who altogether make up the rank and file of the Republican Party.
They may well be killed.
If by some means they do turn him out of office, they will also have to bar him from running again, for his district would reelect him. Hammond has an almost black majority. White people who deal fairly are liked.
A very common view here is New Orleans was flooded on purpose to move Democrat voting blacks out of state. Other disasters get rebuilt, we got National Guard with guns. They kept people from moving back. 1570 people were killed. Louisiana politics.

Well, why am I not surprised by all of this? for, I've known for a very long time that racism and bigotry continue to exist even in a modern day world..Personally, I find way the chief justice did was out right racially-motivated.Come on, don't give me that crap about trying to protect the potential children developing from such..Cause that is just a another way of trying to duck the racist label as such..Well, I am glad that the couple was able to get their marriage regardless and hopefully something good will come of this??
