But was that Autism Speaks or some automatic program on Zazzle? It looks like it wasn't Autism Speaks, and that it could be cleared up very easily, judging by the comments. Sorry, probably no fight this time. |

Autism Speaks is like an ostrich with its head in the sand... completely oblivious to the fact that autistic adults exist and have an entitled right "... to peaceably to assemble, and to petition ... for a redress of grievances," (Article III, Amendment I, Constitution of the United States of America). _________________ The volcanic Rock Spectrum: komatiite -- Basalt -- basaltic andesite -- andesite -- dacite -- rhyodacite -- rhyolite. |

Oh, silly you. Autistics can not be US Citizens, for we are "beings of an inferior order, and altogether unfit to associate with the [neurotypical] race, either in social or political relations, and so far inferior that they had no rights which the [neurotypical] man was bound to respect."
(For anyone who didn't get the reference, that is a [modified] quote from Chief Justice Taney's decision in the Dred Scott Case) _________________ WAR IS PEACE

Why do rich people need more money by suing people who make t-shirts online?
It's not like Zach used their logo or anything. It's a freaking name. I don't understand why Jenny Mccarthy is teaming up with them. |

I'm the owner of the site, it was based on a takedown notice from Autism Speaks. _________________ Aspergers Syndrome News http://www.aspieweb.net/aspergers-news/ |

Zach, you can file a counter-notice to eliminate the DMCA takedown notice... if I read your website correctly, Autism Speaks filed a takedown notice based on a claim of copyright infringement. Copyright infringement does not apply in this case unless autism speaks actually owns the rights to your exact t-shirt design. If they have a claim at all, it would be for trademark infringement, not copyright, and you have a pretty good case for fair use.
Diebold, Inc was recently forced to pay $100,000 in fines and restitution for falsely filing DMCA takedown notices.
I sounds to me like your situation is similar to the diebold case... _________________ Never let your schooling interfere with your education. - Samuel Clemens |
