<<A 17-year-old Bronx high-school student wants the city to pay him $5 million because a Snapple vending machine fell on him at school as he shook it. Court papers filed yesterday charge Albert Salcedo suffered a broken foot and ankle in the incident on May 25...

Salcedo, 17, was in the lunchroom of Theodore Roosevelt HS in The Bronx, attending a nighttime GED class, when the Snapple machine malfunctioned. "It ate my dollar, so I shook it very gently," he said. "It must have been top-heavy, because it fell right down on me."

Salcedo said he was in the hospital for two weeks, undergoing two operations.

The Department of Education disputed Salcedo's claim. According to the high school's incident report, Salcedo "pulled a vending machine down and it fell on top of him."

Salcedo's mother, Diana Tineo, acknowledged that her son had sued before. He received $30,000 to settle a 1999 case in which he suffered facial cuts after he fell through a broken school fence.>>

Did he not read the warning? Vending machines clearly have warnings not to shake them. When I was in high school and the vending machines ate my dollar, I'd always go to the office and they'd give me another dollar. This adolescent is stupid.

Vending machine's do not fall over by-themselves, this guy HAD to have been shaking it heavily, it would deny physics otherwise.

The warnings are plastared all over these things and the dude should have been careful. Sucks to be him I say, the case should be thrown out and the kid not get a dime.

Shaking a vending machine will not give you your money back. It also will not allow you to steal anything from the machine. There is absolutely no purpose in shaking a machine. At my high school, they had to put the vending machines in cages because some people kept coming on campus overnight and vandalizing them in order to steal the money (they broke out the dollar slots), therefore making them impossible to shake.

I guess he became a 'chip' off the old block. Be a while before a Mars a day will help him 'work rest and play'. Plenty of rest, but nothing much will be working. But then again, 'life's pretty straight without Twisties...'

Sounds pretty dumb, I doubt he will get his $5million, why do some people think that hitting machines will get them to work.

The guy is from Theodore Roosevelt High School in the Bronx, which is a school filled with losers (day AND night):

"No one disputes that Roosevelt is a troubled school. It reported unacceptably high drop-out rates and low test scores in 2001, the year it was slated for elimination. By 2002, 85.7 percent of the Roosevelt students who took the Regents Competency Test in English failed it; 40 percent failed math. That same year, only 33 percent of its seniors graduated.

Attendance rates are equally dismal. Last school year, Roosevelt students on average attended only 60 percent of their school days, versus 83.3 percent of days for the rest of the city’s schools. Vazquez estimates that on any given day, one-third of Roosevelt’s students are absent or truant. Hundreds of students have been listed on the school’s register as freshmen for years because they are perpetual “LTA’s” or long-term absences. "

Had he been dead, our records would have shown it. Let me check my files here, a dumb 17 year old, pulls over a sweeties machine... No, nobody by that description here. Wait, I'll check the recreant vaults. Babagayoth, did you see a dumb 17 year old who may have had a vending machine fall on him at school come down here recently? No? You sure? OK. None down here. Maybe you should try the other bloke, you know, that one sitting in the clouds. Jehovah, did you get some dumb 17 year old who pulled a vending machine on to of him... No? Then he couldn't have died then. I suggest he still must be in the hospital awaiting his fate.
