Woman gets life sentence for sex with 5-year-old boy
I can't imagine how this is even possible...

She wasn't arrested until 2003, seven years after the recordings were made. That's when a garbage collector found the tapes in a box at the curb outside Lumadue's Volusia County home. They were among videotapes she had thrown out.
This was Lumadue's second trial on those charges. A jury last year found her guilty of the same charges, but a judge ordered a new trial, citing possible juror misconduct and overly-aggressive questioning by a prosecutor.

Do garbagemen normally go through and watch random videotapes that are thrown out along their routes? That doesn't sound right to me, I mean yeah in this case he uncovered a greater crime but day to day that's kind of creepy. People really should be more careful of what they throw out though, I mean if I had evidence implicating myself in a major felony I most certainly wouldn't have left it in a box on the curb.

If I was a garbage man, I would. I find that kind of stuff interesting. I hope she goes to what ever evil afterlife she believes in (or get very badly hurt in jail.). Hurting the innocence of a child is just sick!!!!
and I'm wondering, who was this child? He would be about my age now. how did she meet him?

if she was a man who did the same, chances are she would have just gotten probation.
We had to research this in one of my class. it was something like a women's first sex offence nets an average 5 year prison term - whereas man would have to be charged on 3 separate times to get that. I'm going from memory here so my stats might not be exact but it gives the ball park |

What now? Where I live, a guy doing the same would have gotten life, no parole. I believe each count of raping a child under 7 carries a minimum 30 year term here, and posessing a video of it carries 10 years on top of that... making the video also carries a 30 year term, and assuming it was not their own child, abducting the child is an automatic life sentence (a child in this case would automatically be considered kidnapped, since no parent would or could consent to this).

Actually, in Texas they tried to execute a man for having sex with a 12 year old girl. Women seem to actually do stuff like that more often whereas men seem to get falsely accused of it more often.
In this case, its hard to imagine a 5 year old with a package big enough to even penetrate an adult woman. So I suspect it wasn't actual sex, but probably still inappropriate.
Although what she did may have been wrong (or not if she was truly under duress), I think life in prison is too stringent. Don't forget that a woman and her 12 year old son not far from here in Dunbar Village had sex with each other under duress also. No charges were ever filed against her nor should there have been. |

The duress argument could only have worked if she had reported the incident to police immediately upon getting out of the guy's immediate presence. Had she gone straight to the police as soon as he left her alone or fell asleep, she would have been held blameless. Since she didn't, her duress argument was not credible. She had no explanation of why she held the tapes for so long, or why she threw them out instead of turning them over to authorities. Her actions long after the original crime showed that she was a willing participant.

My soon to be ex-brother-in-law was a "waste disposal engineer" for a while, he would come home with all sorts of "junk". From, yes, movies, to chairs and tables, and an untold amount of VCRs. |

Anyone sh** thick enough to throw highly illegal and incriminating materials into the rubbish for the binmen to see is probably stupid enough to have labelled them "Kiddy Porn"
edit: I've just been reminded that, over here at least, its illegal to dispose of video cassettes in the standard trash, in the same way it is to put batteries in the bin. Perhaps these items might have been deliberately removed because of this?
Of course over here, its fairly standard to have your rubbish checked to see if you're recycling properly, so its good practice to check your crap first for any personal details etc.

In your opinion, what crime would merit life imprisonment if not sexual violence against a child?
