i posted a thread earlier about the news report regarding javan and joshua smith. it has now been put on youtube. here's the link:

javan is a single father of an autistic child. he was visiting north carolina and north carolina department of social services took joshua claiming neglect. javan had left joshua in the care of a babysitter who was a registered nurse.
javan is the vice president of the autism society of greater san antonio. he is also on the spectrum. he is the first person on the spectrum to hold an executive office in this organization.
please watch the news cast and feel free to post comments. they are very uplifting to javan.
also, please pass the link on to everyone you know. it is very important for this to get in the public eye and the media. even though the judge said north carolina is to hand over joshua, he is not home yet. we need to make sure he comes home!!!
this case is very important to the autistic community. joshua is not getting his needs met at all by north carolina. plus there is the discrimination issue of adults on the spectrum.
please help by passing this information along to others.

Sad that that happens over there as well, hope it doesn't become more common. Over here, it's a major state undertaking with roughly 1 in 70 children in foster care in spite of very few of these cases actually involving missing parents or parental neglect, but rather the government deciding that some parents are generally unfit to be parents, people on the autistic spectrum get victimized a lot by "CPS" here. It's been a social engineering scheme for most of the 20th century to take children from their parents, and recently it's become a business model running foster care homes too.
Hope that father and his son are reunited, over there you at least have a real legal system that lets you challenge public decisions instead of having a state autonomy. |

thank you so much for your reply. i couldn't begin to know how things are in your country, but it sounds bad.
i am hoping the law will prevail in this matter and josh will be returned home, but his particular area doesn't even follow their own laws let alone laws from another state.
jay did get the order signed today. he and his lawyer worked all weekend to get it wrote up. the order states that north carolina has been abusing/neglecting josh. they have until june 25 to turn him over. after that the fbi/us marshalls/da office can pick him up.
we are very worried though because they have transfered josh out of state on prior orders as a means of obstructing justice. that is why we are trying so desperately to get the national/international media and public involved and aware of this situation. if we have a huge public outcry, then maybe jay will finally get his boy back.
jay and i have been working down here in san antonio to help dispell a lot of the myths about autism. we have spoken publicly about what it's like to be on the spectrum. we want to stop a lot of the abuse that goes on with children/adults on the spectrum.
i too went through a cps ordeal. one of the things i noticed was that cps seemed to think that because i was autistic i was therefore stupid. they quickly learned otherwise. my ordeal was nothing compared to what javan is going through.
i'd hate to think how many other people are going through nightmares like this. i hope that all the work jay has done these past two years will not be in vain and not only will he get his boy back, but also open doors for other families in similar situations.

| That Child should return home to his father. Its stupid that the state doesn't trust parents that have kids with disabilities. I would sue the state right away if they tried to do that. |

trust me, javan has done everything under the son to get his son back, and he's still fighting. he was up all night working on this and just now collasped for an hour or so nap. he'll be up soon and back at it.
thanks for your support. it's greatly appreciated. hopefully we'll be planning a homecoming soon.

at this point, nc is still refusing to turn josh over. there was a news video released on channel 9 in north carolina

parul joshi (the reporter) did a fabulous job. even this was supporting us, and that's saying something considering it was in north carolina!!!
we don't expect nc to hand over josh at this point; however, with enough media coverage and public outcry, we might be able to get enough pressure for them to do so.
the thing to remember is that they are not handing him over to javan, but TEXAS CPS!!! if texas then wants to investigate javan and make sure he's a fit father, they can. i doubt this would happen. chances are texas will hand him over to javan because there are no probable causes to keep joshua, but nc should have no problem in handing a texas child over to texas cps.
this has been a total nightmare for javan, and i can only guess as to what it's been like for josh, especially considering that nc was found to have been abusing and neglecting him (and we had proof of that).
the other thing we are hoping is that maybe joshua saw the news cast, or someone around him saw it and has told him about it. they have not allowed jay to have any contact with his son for a year and half. at least if josh sees or hears about that newscast, he'll know is dad is still fighting for him!!!

Updated news story on Javan Smith dated June 25th 2008

A custody battle between our state and Texas continues tonight. Last week, we told you about a father in Texas who's been trying to get his son back from Carteret County Department of Social Services, for about two years. Earlier this month a Texas judge issued a Writ of Habeas Corpus ordering DSS to return Joshua to Texas Child Protective Services. They had until today to do that.
Carteret County Department of Social Services Director David Atkinson sent us a signed and certified version of a Virginia court order. We called the courts to make sure it was legitimate and it is.
It's an order from the Circuit Court of Norfolk that says the Carteret County General Court of Justice has exclusive and continuing jurisdiction over Joshua.
It also says that Onslow County DSS before turning the case over to Carteret County found that Joshua was neglected when he was with Smith and that a psychologist’s evaluation found Smith had “several mental health issues”.
The order paints a picture of Smith as an unfit father who had hurt his son.
David Atkinson says "If we believe that the judge in that case included nothing but the facts you have to conclude from that somebody isn't representing the truth either a judge in Virginia or an in individual in Texas."
Javan Smith is that individual in Texas he disputes all of those claims, points out he is the Vice President of the San Antonio autism society and that he always took good care of Joshua.
Virginia's involvement stems from the fact that Carteret County DSS moved Joshua to a residential treatment facility there. So smith tried to get custody of his son from Virginia.
The Virginia judge ruled that Virginia didn't have jurisdiction to give up Joshua essentially keeping him in North Carolina custody indefinitely.
Meanwhile the “Writ of Habeas Corpus” issued by a Texas judge earlier this month still stands according to Javan Smith's counsel.
Now that June 25th has arrived and Joshua Smith has not been returned to Texas Child Protective Services, the FBI is involved.
Javan Smith says, "I'm really happy they're looking into this it means to me my son's going to be safe soon."
I spoke with an FBI representative who says while the Bureau does not have an official investigation going on right now the FBI in San Antonio is making inquiries on behalf of Mr. Smith in an effort to resolve this issue in the best interest of the child.
Meanwhile two states have two very different views on where a little boy should be and a father determined to bring his son home.

The truth is that Javan Smith is a fraud! He fled North Carolina to prevent his son from being taken from him because of his own neglect by North Carolina DSS and came to San Antonio, Texas. He went back to North Carolina after a two month stay in San Antonio, not on vacation but to visit his girlfriend and was arrested for “communicating threats” it was then that North Carolina DSS became aware of his presence and took his son.
Javan has made elaborate claims of being in the IT business, ownership of a $350,000 house…….None of that is true! April Love (his mistress of propaganda) only states things that will give Javan public appeal and support, she is just as blind as the others who have jumped on the Javan band wagon of support. I do hope that this goes national because unlike other news agencies they do RESEARCH! They will find the skeletons in Javan’s closet and he will be eaten alive and exposed for the liar and fraud that he is! Parul Joshi of WNCT channel 9 did her research and wrote another story about Mr Javan Smith ( the updated story is dated June 25th and exposes Javan for the liar and fraud he has always been). |

I find something interesting in this case in that the children's advocate hope4kidz has jumped on Javan's bandwagon of support to have Joshua brought to Texas and be placed under the authority of Texas CPS when hope4kidz publicly denounces the Texas Social Services System. On the hopoe4kidz website you will find their own negative content regarding children placed in this state's foster care system yet hope4kidz is attempting to bring young Joshua Smith from protective custody in North Carolina to suffer in the Texas system she so loudly denounces. http://www.hope4kidz.org/index.html
Something is very wrong when the group's founder denounces the state of Texas when it comes to looking out for the welfare of its children under state care yet at the same time finds the state appropriate for the transfer of Joshua. North Carolina, who has jurisdiction over the child and the case, is the better place for Joshua since it seems, according to the hope4kidz website, that Texas may end up offering a worse environment anyway.
I pray that North Carolina holds steadfast in its effort to protect Joshua from harm. In addition, I think North Carolina needs to work with Joshua's mother to help put her back in touch with her son who Javan Smith took from her and from the state of New York. The mother seems to keep getting left out of all the public discussions and I think someone needs to speak up for her. Javan Smith has habitually denounced the mother of young Joshua making serious claims against her character and person which seem to closely mirror false domestic violence accusations that one parent might utilize against another to bring about in a child a condition now coined Parental Alienation Syndrome. Joshua deserves to have his mother back in his life and Javan Smith needs to stop his exaggerated efforts to disgrace the mother as he has been doing since he took their son from her and left New York. |

i will again state that katy north and finding truth are out to smear javan. finding truth has posted on another forum javan was posting on. katy north has sent threatening/harrassing e-mails to people involved in the case.
these people or person or whoever the heck they are, do not care in the least about autism.
if any of the moderators would like to talk to me privately in regards to katy nroth/finding truth, i will be happy to do so.
i do not want to give this person/people any more time than they have already taken away from our efforts at rescuing joshua.

| It's really hard to tell who's worse, the person who spams the forum with 4 seperate posts on the same subject, or the person who replies to all those posts. Frankly I think the both of them can go somewhere else and argue. |
