According to the text quoted of California law, assuming this was done in California, it says you should file an anti-SLAPP petition.

Another thing you could do is go to other merchandisers. And you could (annomously) forward the designs to Autism Speaks. Keep their paid goons busy. Just keep doing different designs with "Autism Speaks" and "'Autism Speaks'". While you're at it, forward all the designs you can find that have "Autism Speaks" on it to them...

Another thing you can do is request removal of their items. Legally speaking, they have to refute your claim, requiring their time. That, of course, would be stooping to their level, but if you're an eye for eye kind of guy... It is by no means "legal action", but basically sending an email saying "they're infringing". The vendor then does a chicken dance and takes down the material, but thanks to the DMCA and SLAPP laws, they're actually required to remove the material.

It looks like I was right all along. Zach and codeman had the good grace to apologize for their groundless allegations against autism speaks. I am still waiting for Alex Plank to do the same. Yet he still seems to want to keep this mistruth on the front page of wrong planet let alone offer a retraction and apology.

First off, I don't think anyone who tries to raise awareness of how AS are trying to wipe Autism off the face of the Earth via barbaric tests and supporting mothers who make statements about driving themselves and their Autistic kid off a cliff, really needs to appologise.

The next thing we know they'll be using some anti terror law against our peaceful protests, because that is the kind of thing companies do. AS are just that, a company selling a bad portrail of Autistic people. I spent 6 years at a Autism specific school and they were the best 6 years of my life, I learned most of what I know today not from teachers, but from people on the spectrum.

I can't see how using the words "Autism Speaks" is a violation of copyright. Using their logo, images or written text would be, but 2 words, I highly doubt it. There is a site called "Tescopoly" which tracks the activities of the supermarket chain Tesco, this site uses Tesco's colours and speaks about their treatment of staff, foreign labourers, customers, other businesses and the general public. This site has been about for a very long time, as I imagine the owner knows his stuff about free speech and what he can and cannot do with Tesco's name.

Zach is not forcing anyone to "bash" AS, he is simply offering a different side of the coin.

Keep up the good work Zach, we need more people like you on our side.

I've heard Autism Speaks have patented Autism and we are all to be sued for being unlicensed products, you have to admire them for their moneymaking scams, sorry - schemes Laughing . I can't see them wiping out Autism as it's such a good money spinner for them, after all they want to keep their snouts in a well filled trough and promoting then playing on peoples desperation and misery is a really good way to do it. So good people let's raise a glass to Autism Speaks commendable entrepeneurial spirit (Alex, I can't find a vomiting Emoticon!)

First off - it was not groundless. Evidence was in hand and Zazzle was saying it was Autism Speaks, plus it was based on AS' previous behavior. That would be enough if you ask me - but you cant make the trolls happy.

Hey, how do I say this...I went on their site to check what this is about, what they are about. Among some things that some here may not agree with (some descriptions too dramatic), I also found some paragraphs about research they have funded (in the History section) and I thought it was interesting (something about a study on "fever-induced" relief of some "symptoms").

I do not want to offend anyone but I think there are good parts too...you know, there's so much not understood about AS/autism that putting money into research can't hurt. If you can find out more about the mechanism, the genes...money is needed.

And if people feel misunderstood, well they should explan the misunderstanding and stereotype calmly and effectively. Maybe they have seen only some parts of the spectrum while you are referring to another. So communication, rather than a raised voice on all sides might lead to something positive...and some type of common goal/umbrella. Just my opinion.

Someone might enlighten me here but, how can an organisation copywrite a term of speach or reference such as "autism speaks", not possible to do same as someone from Australia copywriting the term "home of the free and the brave"? I think that would go down like a lead balloon! No company or organisation no matter how much money they have or how great their lawyers are has the right to encroach on the freedom of speach or text of any individual or company unless that is proven to be unique text or in the form of original statement or language form.

Realize that these blowhard legal firms representing copywright use intimidation as their only defence call their bluff and defend yourself by telling them to take a long walk off a short pier and that they do not own the English language!!!! No-one does freedom of speach and commonsense must prevail!!

It is really worth remebering that in the big bad world out there US Law and all its constituants only represent a "Flees Dick" When it comes to the "World in it's entirety, whilst some of you in the US may take offence to this it is in fact a reality. There are almost as many people in Indonesia some 234,000.000 as in the US. US law pertaining to "Copywrite" relative to the rest of the world is somewhat of a jigsaw puzzle of vibrating inconclusive tsuedo facts by default and definition? Easy solution would be to simply register another business offshore and tell these guys to "get stuffed"! I recently was threatened with litigation on one of my domain names which was thought to be related to those absolute "Crap plastic sandal thingos" I told them to "Dream on"??? Cerebraly challenged Morons.

Yes they would. They want the proceeds from such sales (and may be legally entitled to them). Plus they don't want the impression that some random yahoo on the net is speaking for them (they hire their own yahoos to do that).

Be very careful about all the lawsuit stuff.

You may have "rights," but as a person w/ a disability, those rights are very easily taken away by more powerful people.

The law can be squeezed by powerful lawyers, and I am sure they have powerful lawyers.

As a person with autism, you may find it harder to fight that good fight than to capitulate.

But you are in the right. And I agree with the statement.

Protect yourself however you must and don't worry about ideals. A friend of mine walked a way from a divorce because he felt it was a better emotional deal than fighting. Yes, he lost a lot, but he is also at peace which is more than I can say for the spouse.

Just protect yourself however you must.
