I can only imagine the trial that would have taken place, Cheney would have been found unaccountable for the actions of the torturers that resulted in the deaths of their prisoners and his order didn't explicitly state to kill them. He would have cited that his apparent 'confessions' were non-literal phrases, motivations or misinterpreted like saying, "Make him talk at all costs". It's textbook policy to always keep the problem down in the lower chain of command by cunning wordplay with how you deliver orders and the unprovable insinuations that lie in them. As infuriating that sounds, it's merely business as usual.
