I think they should get the same sentence as the falsely accused. Not that I believe in the bible, but doesn't the bible call that "false witness".
If it could be proved without a doubt that the accusation was false, as in the Duke LaCross team case, yes they should be punished. However if it's simply a case of DNA exoneration or someone being found not guilty due to lack of evidence then I don't think the accuser should be punished because you may very well end up punishing a person who was raped and I think that would have the effect of making victims afraid to come forward, and rapists more likely to commit multiple rapes.
A lot of the accusers of men who exonerated by DNA actually were raped, they just mis-identified their attacker.
You're missing the point.
Right now a man can be accused with impunity whether or not he was even there. By the time the police verify his alibi he may have already lost his job, etc.
An accuser has nothing to lose.
They - and their legal council, and friends, and family - should approach that decision with a measure of care.
There should be something to lose if they defame the wrong person.
There should be incentive to remain discrete and civil and to shy away from attempting to try the case in the press or in the court of public opinion.

With any crime, the key to criminal justice is to create disincentives and deterrence. But if victims don’t report crimes, then there’s no deterrence. It seems to me that one of the reasons to create a more sympathetic environment for victims, including prompt testing of rape kits, is to encourage reporting so as to get the criminal justice system working again.
Incidentally, one element I didn’t mention in the column is that in some states and localities, the victim has to pay to have the rape kit processed. Usually it is the victim’s insurance company that pays most of the bill, and in other cases the victim will eventually get reimbursed — but can you imagine any other crime where the victim has to pay the police to do their work?
The focus in my column was on women as victims, but of course men and boys are raped, too, as are transgendered people. I’m told that the system just doesn’t know what to do with male victims, and that rape kits often aren’t collected from them. Anybody know anything about that?

As a rape victim who has been sexually exploited and abused most of her life, I have a lot to say in regard to this topic. I think it all stems from misconception men have in regards to healthy sexual relationship and also from most men who are unable to express their sexuality in a healthy manner. Obviously the men who consider drugging a woman think of sex as one man play. Generally Sex is what two loving people were supposed to enjoy after they have established a friendship or relationship of some sort for a while.
But for “some” men, they see some girl and automatically sexualise her with no regard for her desire, her wilful desire and consequences. These men think that sex should come first and than perhaps he might develop some feelings for her afterward. but often times, it doesn’t work that way for women. Women were supposed to protect herself especially from possibility of catching an STD and getting pregnant every time she engages in sexual intercourse. so for my case and for many women, establishing a friendship and feeling of trust should come first and than talk of engaging in sexual act should come last. So if man were to engage in sex with a woman she is not in love with, he will most likely have to be prepared for a huge consequence in normal dating world. Not only women need the feeling of security, feeling of trust and love in order to enjoy sex, most women would prefer to have few hours of foreplay, making out sessions before they engage in sex.
although I am not discounting the fact that there are quite a lot of women who enjoy casual sex. Usually the type of women who would fall into this category would be misguided teen women who have been manipulated to act out sexually because usually women who haven’t developed a stable womanhood and sense of herself would usually fall into this type of manipulation by the older men who take advantage of this opportunity. and women with sexual abuse history or unresolved emotional issue would also fall into this as well as women who are chemically controlled or mentally defective or psychologically ruined would also fall into this categories.
Women who are mature and well over 25 would be quite selective about men she choose to sleep with if she was given “options”.

But if you go by the broad definition of rape, Any sexual acts committed using financial control, intoxication, position of power all fall into definition of rape. So if some feminist makes a rather seemingly outrageous claim such as all prostitution is an act of violence against woman, than pornography would also be considered as a sexual violence against women. But since I am not at all against prostitution and all forms of pornography, it’s matter of deciding and questioning her involvement in prostitution and how much willing participant she was in the position. Because a lot of women would be glad to remain in the position whereas for some women who have been manipulated, it’s completely atrocious in every level.
But here’s the bigger problem that I have currently witnessed. There are many psychologically ruined women currently who are and have been in the sex industry . I would imagine Majority of women who have been chemically controlled, mentally abused or financially controlled are psychologically and mentally helpless to give a meaningful consent to having sex. When I say psychologically ruined, I am talking about women who are unable to say “No” due to addiction to sex and chemicals. Whether you had known she had been “controlled” “brainwashed” by the third party previously to act out on her sexual impulses without any sort of inhibition or wilful desire own on her, You would be essentially committing a RAPE because you are taking advantage of someone who is mentally defective or psychologically ruined.
Because if you do a simple research, the definition of rape includes a having sex with someone who is mentally helpless, intoxicated or insane. the mental helplessness can be caused due to chemicals but also through abuse or any type of threats.
Therefore, let’s say a woman has been kidnapped by guys who knowingly or unknowingly drugged her with chemicals for extensive period of time and turned her into a zombie Sex Slave. Because the part of her brain which is responsible for her judgement, impulse control and Hormones levels, which are all simultaneously used to control her sexuality have been severely damaged to the point of almost no-recovering, She could enjoy having sex with multiple men with giant penises for years of time and participate in gang-bangs and even decide to get a breast implement to attract more males for more sex.
But she could be someone who would never consider getting a breast argumentation nor even get near guys with huge penises let along enjoy giving him an oral sex or drink someone’s sperm if she has never been chemically controlled to act out her sexuality in that manner.
It’s up to the moral judgement on men to decide if gaining access to such a woman in such a vulnerable state would be acceptable especially if she is an willing and active participant in the circumstances.
Because whether she was drugged or not, Rape is still rape. you still experience the devastating psychological, physical pain afterward especially when drug is completely worn out of the body, that’s when you experience the most excruciating pains.
I believe any type of sex acts carries a huge responsibility whether we like to admit or not. I believe men should make careful psychological evaluation and do simple analysis to decide if you are having sex with a sane woman who likes you for who you are or simply taking advantage of a trafficking victim who has been chemically and psychologically controlled in the past. and if you are the type of man who spends enough time with a woman instead of trying to engage in sex right away without establishing anything, you should not worry about taking advantage of someone’s mental helplessness or insanity.

While I'd agree that Inuyasha's arguing is mostly completely and utterly illogical as evidenced in the other thread on abortion as well as his own one on the "slippery slope fallacy", that particular claim is not completely unfounded. Contrary to popular belief, rape is actually not a male-only offense and yes, it is perfectly possible for a woman to rape an adult man (as well as other women for that matter), so it's not restricted to underage boys. Also, it is highly probable that men would not report it they know that they are highly unlikely to be believe. See the following paper for example:

I agree that taking advantage of an impaired woman is rape on a scale quite different from some other kinds of rape.
I'm not so sure that a woman who feigns a sexual appetite that she doesn't really have in order to maintain a relationship with a male person who provides financial resources or emotional validation is really rape. It ignores the fact that a lot of guys are dumb. You are essentially proposing that a guy who is being manipulated for financial gain is unknowingly raping the woman.
What you seem to be proposing is that any sexual activity a woman finds herself engaged in that she might not have engaged in if she were emotionally and financially independent is de-facto rape. I think this is going way, way too far.
I think there is a bright line called consent. And an even brighter line called committing an overt act.

Also I certainly didn't interpret what he said as meaning that they're getting "less likely to be reported" than before because I don't think it was ever likely to be reported, considering that even the possibility was not even considered. As you have said, taking advantage of an impaired woman is considered rape.
I was specifically referring to organised crimes or systematic rapes that have been and are prevalent in the society that I have witnessed.
If you have never been victimised or sexually exploited like some other women have, I think you are being quite naive about the current reality or don’t comprehend how far men would go to acquire sex from certain women.
I’d say great majority of women have sucked into the sex industry against their will. I am sure there are few who are quite content with whatever they have done and received as a payment for their work. But often times, especially when women are young, they get manipulated by the “third-parties” to spend more or they get put in situations where it’s nearly impossible for them to escape financially for extended period of time where they have no other choice but be available to strange men sexually for them to earn money.
You may say we are all indebted by the system and No one is absolutely free of this. but These women have been selected and the ones with financial control created this web of slavery system by causing “unnecessary” hospital bills, “Planned” Car accident, using a naivety of young women with little knowledge of how to spend money or use credit cards.
When these women enter a college, they get endless offers to take out a huge loan. I for one get endless messages daily of these offers. Don’t you find it kind of ironic that I could get these loans with such an ease? and How come other men or other people do not get these messages? How come I hear the exact same story of these having these exorbitant loans in their bank account from other women who have been cheated and manipulated by the system and the third party who mysteriously disappeared?
I believe it’s a situation that is nearly impossible to escape for a woman who are obviously defenceless and have less financial control in the society.
And When I say “impaired woman”, I wasn’t talking about women who would be gladly get money from men and emotional validation from men and content being remained in the situation. Because there are plenty of women who would rather do work in sex industry than have a normal job.
But I am talking about Other women like myself whose spirit and independence have been broken using tactics like rape and drugs. and how it may be nearly impossible for them to gain the sanity and even find the will to go on living the life without resorting to drugs.
Because these women should be viewed as victim of serious serious crimes rather than a drug-abusing prostitute. If these women have never been raped or drugged in the first place, they would be able to be financially independent and make a living for themselves without having to lead a dangerous lifestyle by sleeping with various men for money and to have access to the drug.
I don’t know which country you are from. but in UK If you do sleep with a trafficking victim who have been “conditioned” by the third party to remain in the position, it is a rape, whether or not you had known if she is controlled by the third party, pimp or conditioned with drugs.
It’s worse in Sweden. If you are a woman and are in need of money, you are free to prostitute yourself because that’s what human beings would do if they were left starved, but if you get caught using the services of these women, the man will get prosecuted by the law.
and I once heard, Once you have been conditioned or “groomed” by the third party as overtly sexualised drug abusing woman, it could take anywhere from 5 to 10 years for them to ever gain sanity and find the strength.
Which means many men could take advantage of the impaired women who are quite defenceless for years of time and make a huge profit off her impairment.
If you think I am going to far with my definitions, I would imagine you are being quite naive about the reality of these destitute women and how we are turning blind eyes to the serious crimes that are happening right in front of our eyes.
What does it take for these women to ever escape these lifestyles without having to be raped by men she doesn’t want to be near? Rape is non-consensual sex; since men can be physically aroused whether they want to be or not, they can be raped. It's a horrific crime regardless of who the perpetrator is or who the victim is. I don't agree with Inuyasha that men are as commonly the victims as women are, but I absolutely do agree that it is not somehow a lesser crime just because the victim is male. If a rape victim is ashamed to report their rape because of how they will be perceived and/or blamed by society, the problem is with society and not with the victim.
