To clarify, kissing a girl on the forehead... obviously they clarified it as sexual assualt :(

I used to hug and kiss people a lot when I was a kid and once air kissed a boy and I got in trouble for it, not suspended.

Link doesnt work for me, either. Kissing someone on the forehead is just a way of showing affection. I also communicate through touch. We dont always know what's appropriate and what isnt. Was he kicked out of school permanently, or just suspended?

either way, it's wrong. He didnt know it was appropriate and didnt do it deliberately to annoy. He should simply be told when you can touch, who you can touch. All those social rules are complex, and the kid needs to be taught, but not punished, because it's always wrong to punish someone for something he didnt do deliberatly, when he meant no harm. never punish someone for something he did innocently. it's an injustice.

But still, just apologize and explain your intentions and the woman would have seen it was just a misunderstanding and won't feel assaulted anymore and move on. I am sure he was embarrassed when he realized it was the wrong girl. It happens to normal people too when they tap someone on the shoulder, slap their butts, etc.
