It's not really a surprise but is definitely something that should be ended. How can they allow something that has been ruled to be illegal by this same court to continue on until November?

Because it was different courts and judges have been ruling on the matter.
Granted today it was different judge in 2nd Court of Appeals that ruled on this matter.
The D.C. courts have also ruled not this matter too.

There are 13 U.S. court districts with each top court being one of the U.S. Courts of Appeals.

The D.C. Courts and Washington Courts aren't listed due to them being special and equally as powerful to the regular court districts.

Even if the program was closed the NSA could still get a lot of data simply by creating false marketing companies and buying them from Google and Facebook.

NSA would just buy the data, granted it is more expensive to do so.
They know better than to create fake companies and the legal repercussions of doing so.

Anyways the new system for the NSA should be up and running making this ruling obsolete, any day now.
