There's no guideline that specifically says that bilingual children with delayed speech are allowed or denied the diagnosis. It only says language retardation rules out AS - which gives no indication of the existence of any exceptions.
So the same question is raised with hearing impaired children or those with a temporary hearing impairment (caused by an infection of the middle ear or similar).
In most cases those with a language delay due to a (temporary) hi are classified as PDD-NOS, not as AS. Because it cannot be assessed whether they would have spoken on time if circumstances had been different. PDD-NOS would be the only correct label.
To give a diagnosis of AS or PDD-NOS is something the professional can do as they see fit though, no matter whether you meet the criteria or not.
