If you can, somehow, prove "extreme hardship," bankruptcy would be less of a bad option----but still a bad option.

You would, basically, have to live on a cash (and crappy debit card) basis for 7 years.

Why are debit cards crappy? I used them all the time.

Also, it's not so terrible to live off of cash. I do it.

Once in a blue moon if I have to pay for something online that doesn't accept visa debit then I borrow someone's cc and pay them. Same for paying cc only parking. Not that inconvenient since I can borrow a cc as absolutely needed.

But I pay for 99.99% of things in cash/debit. So long as you have some cash, it's not a bad way to go at all. No debt, no interest, no cc fees etc just spend your money on the things you need.

I've never heard of that. Every webstore and parking garage I've ever used accepts debit cards as well as credit cards.

Not here. Some are credit card only. Some are credit card or pay-by-phone only, but you still need a phone app and a credit card attached to it lol. So yeah, sometimes I choose parking based on meters accepting coins/cash. Other times when I have to park at a certain spot I use a borrowed cc and pay that person cash. So far it's been an ok workaround.

Bankruptcy would cancel your non-student loan debt

But not your student loan debt unless you can prove "extreme hardship."

It's possible that an Asperger's diagnosis could help prove that "extreme hardship."

Sly: I don't know about registered guns, but I've never heard of any bankruptcy where anyone comes to seize and sell simple personal possessions like a tv/ps4 or small coin collection. When I filed mine years ago and had to list assets it was a few dollars and some sporting goods I own - they're not interested in taking anyones several hundred or few thousand dollars worth of stuff. It would be different if I had a house, investment accounts flush with cash, a paid for car in the driveway worth more than a few grand etc. All the small stuff they couldn't care less about.

Here they can come inspect your house for valuables that could be sold to pay off your debt. I’d have to list everything I own I don’t even know what all I own. :/

Most valuable stuff I have is my guns, tv and PS4, and my coin collection collection. But my coins aren’t even that valuable as to try to get their “worth” would require putting them on eBay and waiting for right person otherwise they worth only $8 each .I found them cute so I bought one and gotnothers as gifts.
Some of the others are worth little more. And actually might get less then $8 from panwnnshop since most people don’t like colored coins.
On paper my guns are worth $4,000 but that buy price and your get 1/4 they when selling.
Took me 12 years to slowly get them :( I’d be defesated to lose them. Few of them aren’t even available anymore. They’re hisotrical surplus and it’s dried up. Like one sales for $500 from stores now but I paid $100. I dont know how they’d value them. I only have receipts for few of them. So their actual sell worth is far less. Which is why I swore I’ll never sell guns. You lose so much doing so.

I read up it would cancel my credit card. Me and my family rely on my credit card. I dont know what we’d do with out it. It’d paid off every month never had interest on it. It’s why my credit score is high. That and he government paying my student loans.

Government says I can’t pay my loans back on my income so currently I pay nothing and have to do review every so often. Would that not be hardship?
Though again if they canceled the student loans it’d just become irs debt and I’d be put in prison for being unable to pay.

Yes, if you are in bankruptcy, they would cancel your credit card.

Where did you get the idea that you would be put in prison for not paying your student loans?

It's a fundamental principle of the US system that "people cannot be put in jail for debt."

Saying this, I've heard of this sort of thing happening in places like Arkansas, and some other states of the Southeast. It doesn't mean it will happen to you. I very much doubt that this will happen to you.

I'm not saying it's good to have student loan debt; its very bad. But it's not a criminal offense to be in debt.

From what I understand you can go to jail for failing to pay your taxes. Rich famous people go to jail for it all the time. It’s how they got al capon
Forgiven loan debt becomes taxable income so if you have 20,000 student loans and get t forgiven then it’s as if you made a extra 20,000 that year on your taxes.
That’s be about 3,900 I’d owe if not more. Clearly I wouldn’t be able to pay that. So they’d lock me up for failing to pay my taxes.

You can go to jail for EVADING taxes. That's why all these famous people are in jail. For filing false tax returns which serve to EVADE paying taxes.

As long as you keep in contact with the IRS regarding your tax debt, you almost definitely won't go to jail. They do put liens on your property, though.

Tax debt is not the same as credit card debt.

You don’t have to file for bankruptcy to find out the numbers. Just go ask a professional to calculate them and find out vs wonder. Math will tell you if it’s your best option or not.

As for material possessions, if someone would really come inspect your home for valuables.. store them somewhere else for a while. ;)

As for cancelling your credit card, IF that’s a requirement for filing, again, crunch the numbers. Maybe you’d save enough on debt payments that you won’t need your credit card at all to cover small bills because you’ll free up enough cash to pay for things without using it.

Further on the cc, you say your family depends on it as well. Why? How are you, someone with a total income of $942.50/month, expected to be a provider for anyone else? What about their income sources? Welfare/working etc? No matter how little I earn I’d always do whatever I could to help make ends meet for my family if they need it, I get that, but I do wonder if any of your family members are taking advantage of what little money you have coming in. If so, that’s not right.

Regardless, you really need to speak to a local bankruptcy specialist and find out what all of your options are. You might find out that filing makes sense and will free up money every month as well as relieve a lot of stress.

Lol so does not being able to pay all your bills.. so as long as you don’t make the same mistakes and go into debt again, at least after 7 years you have a clean slate. I have less than 2 years to go on that.

In terms of getting a car loan or mortgage, there’s not much difference between not paying your bills for a really long time and filing for bankruptcy, so sometimes it’s an acceptable option, and really, sometimes it’s the best option.

Sly doesn’t have the $110k of debt I did. And it sounds like he hasn’t really been missing payments. So, maybe it’s not his best option.

I’d say don’t file if he has any intention of getting healthier and earning a higher income any time soon that would allow him to pay everything off over 5 or so years. But if he’s of the mentality that he will never ever in a million years work more or make more money because he doesn’t want to improve his health nor work or earn more money, then filing may be the best bet he has to make the most of his $942.50/month for the rest of his life. Up to him - and the math.

I still think sly should go see a local bankruptcy professional and ask them to crunch all the numbers and inform him of his options.

I can’t afford to see someone or even file. I ebelive it’s $300 to file bankruptcy and then court fees.
I did go see a law student. But they were much helpful.

That’s bankruptcy fraud and is punishable . Just saw a story where guy hid $85k in a safe and also sent 300k to his son to hide before filing and they found out about it.

To be clear I don’t pay anything to credit debt. I don’t make enough. They get 25% anything over $418 net. I don’t usually make $400 after taxes. Bankruptcy would slightly improve my situation if I was ever to find full time work I could manage mentally.

Whenythry buy online they use it. Anything bought his month isn’t due til next month . Makes it easy to manage funds. I do that a little bit mostly use my money I have. They’ve gotten backlogged though >.> so I’ve been buying stuff and paying it off early to lower their payments. It’s cause she had 140 on cars then car broke and she got the new one and then couldn’t afford that payment.

Bankrupt people have no money. Filing fees typically require a deposit at least, and then monthly payments to pay it off during the insolvency period (here) - it cost me around $9xx over all. I put $100 down and paid under $100/mo for 9 months. If I earned more than ~$2k net/mo they would get all the extra money, distribute it to creditors and keep 15% for themselves. (That’s how bk trustees make money.)

If you talk to a professional in your area they will calculate everything and present you with your options. Even if filing is Not in your best interest, at least then you’d know vs wonder or assume.

Major fraud committed by big fish like that is their concern. No one gives a s**t if a poor person keeps $1200 worth of anything. It MIGHT be technically against the rules, but those are rules I’d break if I were in your shoes and the chance of anyone ever wasting an official’s time to micro-analyze your material possessions is very slim to none. Besides, if you gift those possessions to your sister now they’re “hers,” anyways. ;) I know it’s your aspie nature to be honest to a fault, but really, honestly, no one gives a s**t about a couple hundred bucks worth of things. It’s the guy hiding six figures in a safe that they’d be concerned about.
