Nobody is going to waste the next few hours of their time to read Terms of Use Agreements when they install new software. But someone told me that if you read it, you'd see that they (along the lines of): "forbid use of Apple software to develop, distribute or activate nuclear weapons..." some sh** like that. I read it, and it was really there.

I finally ordered my new hard drive for my laptop and received it yesterday. I'm in the middle of installing the software I normally use. I decided to read the iTunes disclaimer again for sh**s and giggles.

You don't see that now; with iTunes 10 they replaced it with a notice regarding a corporation called "3Com" that forbids use of it to operate with air traffic control/navigation/communication, nuclear facilities and weapons systems. They still retained the nuclear stuff, but it's nowhere near as funny as it used to be. But iTunes added some other stuff that regarding 3Com that states that they are not liable for data loss and performance failure caused by events (beyond their control) such as: (it's hilarious as each one gets more ridiculous than the last, although I'm too lazy to type them all) internet failures, electrical power failures, strikes/labor disputes/labor & material shortages, "acts of God," and war, etc.

Wtf?!

Damn, I guess I have to return my Apple products for violating their EULA.

I am sure that is only there for legal reasons.

I have an insider view of the electronics world, I know that for a system to be fit for use in medical , nuclear, millitary or space service is needs to pass additional tests. Typical comsumer electronics will never have been tested to the level required. So the serious well behaved parts of the medical and nuclear sectors such as ABB, BNFL, Philips, Siemens, Westinghouse etc will not blindly trust microsoft XYZ to run a critical process. On the other hand some corner cutting bad guys in some rouge nation trying to make plutonium, build bombs or cheap pacemakers will feel no problem with buying an electronic game or normal PC (Saying its just for playing world of warcraft, honest !) before going off to do their unspeakable acts in some dark corner.

The latter group of people can not be delt with by a disclaimer, the only way to stop these bad guys is to prevent the export of electronic and computer goods to the nations where they lurk.

Further, this indemnifies the corporation against any legal liability when some nitwit takes his laptop into a nuclear power plant, leaves it sitting against the containment vessel, and comes back later to find that particle flux has destroyed his motherboard. (And yes, there are people every bit this stupid; and yes, most of them would file suit immediately afterward.)

When I was in the Air Force, my auto insurance had paragraphs denying coverage for damage caused by nuclear war, nuclear radiation, or falling aircraft or spacecraft parts...

Of what use are unenforcible terms in a contract?

It also says:

Quote:
THE APPLE SOFTWARE IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL SYSTEMS, LIFE SUPPORT MACHINES OR OTHER EQUIPMENT IN WHICH THE FAILURE OF THE APPLE SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.

Which reminds me of an instruction manual I read, which I think was for an iPod, that warned me not to insert any foreign objects into it or microwave it

Gamestation put in a clause assigning the user's immortal soul to the company. They noted that very few people noticed.

Several of the open source licences, going back decades, have had some really bizarre humorous terms in them.

Many sleeping medications note that insomnia and sleep disturbance are a common side effect. All (?) antidepressants note that depression and suicidality are a possible adverse effect.

From the excerpt I saw, its just the standard waiver that the software is not reliable and they don't want to be held liable.

Oh yeah, I remember this. My thought was, what the f**k does an online music store software have to do with weapons of mass destruction?

I'm going to have to start reading EULA's in full again instead of just skimming through the pertinent parts and clicking OK.

I'm always OCD about reading software licenses before agreeing to them. Luckily, most of the stuff I use is GPL, so that cuts down on the reading.
